Once the relevant provisions are in force, a local housing authority may impose a financial penalty of up to £7,000 for a breach of the database duties.
A civil penalty of up to £40,000 can apply where a database offence has been committed, including certain continuing or repeat breaches or knowingly or recklessly providing false or misleading information.
The legislation can also restrict possession where the landlord or property does not have the required active database entry.
The PRS Landlord Ombudsman: what comes next
The PRS Landlord Ombudsman is also part of the reforms and is expected to follow the database, with mandatory landlord membership planned for 2028.
Landlords can prepare by maintaining clear records of tenant communications, complaints, repairs and completed work.
